Federal Circuit Denies En Banc In Union Carbide Case

Law360 (January 11, 2006, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit has denied Shell Oil’s bid for a re-hearing en banc in a $150 million patent infringement lawsuit brought against it by Dow Chemical Inc.’s Union Carbide, leaving the Supreme Court as Shell’s last resort for an appeal.

By a vote of seven to four, the Federal Circuit rejected Shell's petition for a re-hearing with the entire panel of judges at the Federal Circuit Tuesday, allowing the court’s previous decision to stand.
