Fla. High Court OKs Legislator Depos In Redistricting Clash

Law360, Miami (December 13, 2013, 8:31 PM EST) -- In a major ruling, the Florida Supreme Court decided Friday that lawmakers and legislative staff can be called upon to give testimony in a legal battle over the state's redistricting process.

The state's highest court, in a 5-2 opinion, said for the first time that constitutional separation of powers establishes legislative privilege in Florida, but the majority found that the privilege is not absolute when it comes to ensuring the implementation of a constitutional provision prohibiting partisan political gerrymandering and improper discriminatory intent.
