3rd Circ. Bid In Pa. Gay Marriage Challenge Gets Axed

Law360, New York (December 17, 2013, 10:04 PM EST) -- A Pennsylvania federal judge refused Tuesday to certify an interlocutory appeal to the Third Circuit to challenge his decision denying a motion to dismiss a lawsuit that sought to declare unconstitutional the state's ban on same-sex marriage.

Pennsylvania officials had argued that the claims in the lawsuit did not fall under federal jurisdiction and that the U.S. Supreme Court’s 1972 decision in Baker v.
