Criminal Charges For XTO Fracking Spill Advance In Pa.

Law360, Philadelphia (January 2, 2014, 5:02 PM EST) -- A Pennsylvania state magistrate judge ruled on Thursday that criminal charges against Exxon-Mobil Corp. unit XTO Energy Inc. over illegally spilling more than 50,000 gallons of toxic wastewater from a Marcellus Shale gas well site will move forward.

Magisterial District Judge James G. Carn ruled that all eight of the charges faced by XTO — three for unlawful conduct under the Solid Waste Management Act and five for violation of rules regulating the protection of the water supply under the Clean Streams Law — be held for court, and he transferred the case to the Lycoming County Court of Common Pleas....
