IRS Urged To Clarify ACA Mandate On Volunteer Firefighters

Law360, New York (January 3, 2014, 1:11 PM EST) -- Rep. Michael G. Fitzpatrick, R-Pa., is mounting pressure on the Internal Revenue Service to clarify whether volunteer firefighting organizations must provide health coverage under the Affordable Care Act, saying in a letter Thursday that such a requirement will drastically impact the nation's emergency services.

The IRS classifies volunteer firefighters as employees, and Fitzpatrick is concerned the classification could qualify volunteer nonprofits as “large employers” under the ACA and require them to provide health care coverage or pay fines if they do not comply.
