DC Circ. Mulls Ripeness Of FERC Transmission Rule Suit

Circuit on Tuesday pressed Public Service Electric & Gas Co. on the ripeness of the company's case challenging the Federal Energy Regulatory Commission's decision to allow outside companies to build new transmission project's within PSEG's franchised service territory.

A three-judge panel said the case challenging the FERC's allowance of entities' right to build projects and charge cost-based rates in PSEG's franchise zone may depend on a forthcoming court ruling over the FERC's controversial Order 1000, which has not yet been set for oral argument. ...
