Fed. Circ. Revives $80M Patent Suit Against Malibu Boats

Law360, New York (January 8, 2014, 4:21 PM EST) -- The Federal Circuit on Wednesday reversed a ruling that Malibu Boats LLC did not infringe a design patent for a boat windshield, finding that the lower court wrongly held that Pacific Coast Marine Windshields Ltd. was barred from alleging infringement.

The Federal Circuit overturned the lower court's finding against Pacific Coast, which sought $80 million in damages, saying the company had not surrendered during prosecution the design it accused Malibu of infringing.
