FERC Fines Constellation, Entergy New Orleans $5M

Law360 (March 13, 2008, 12:00 AM EDT) -- The U.S. Federal Energy Regulatory Commission has levied $5.4 million in fines against natural gas providers Constellation Energy Group Inc. and Entergy New Orleans Inc. for allegedly breaking the regulator's capacity release rules.

The companies struck a settlement with FERC on Tuesday, putting to rest claims that they had bypassed the regulator's competitive bidding requirement for discounted released capacity, violated the requirement that shippers have title and breached the ban on buy-sell transactions.
