FDA Issues Beverage, Supplement Classification Guidance

Law360, New York (January 13, 2014, 5:58 PM EST) -- The U.S. Food and Drug Administration on Monday released new guidelines designed to clear up whether beverages — including controversial energy drinks — should be classified by manufacturers as dietary supplements, as well as other guidance about ingredients added to foods and drinks.

Some politicians have criticized energy drink makers, which sometimes advertise their products as dietary supplements, for their marketing to kids, specifically pointing to the caffeine and other herbal ingredients in the drinks as possibly being health hazards.
