Okla. Gay Marriage Ban Ruled Unconstitutional

Law360, Los Angeles (January 14, 2014, 9:46 PM EST) -- An Oklahoma federal judge on Tuesday ruled that Oklahoma’s ban on same-sex marriage is unconstitutional, finding that the voter-approved law defining marriage as the union of a man and a woman went against a constitutional amendment.

U.S. District Judge Terence Kern slammed the Oklahoma ban as unfairly singling out a population of state residents — same-sex couples — and imposing a restriction on them in a breach of the Equal Protection clause of the U.S. Constitution, according to Tuesday’s ruling.
