Public Defender Plotted Against Shrink, 11th Circ. Hears
Law360, Miami (January 15, 2014, 7:59 PM EST) -- Forensic psychologist Michael P. Brannon appeared to have an uphill climb convincing the Eleventh Circuit on Wednesday that a lower court wrongly rejected his claims that a Florida public defender had retaliated against him over testimony he gave on behalf of a judge.
Brannon alleges that Broward County public defender Howard Finkelstein violated Brannon's First Amendment freedom of speech rights by acting to prevent him and his businesses from being hired for expert witness testimony simply because Brannon testified on behalf of a state court judge who was under examination by Florida's Judicial Qualifications Commission for allegedly treating public defenders rudely....
