Lancome Asks TTAB To Approve Beauty Product Mark

Law360, Washington (January 16, 2014, 7:05 PM EST) -- Lancome Inc. on Thursday urged the Trademark Trial and Appeal Board to approve its proposed stylized "Ô d'AZUR" mark for various beauty products, claiming an examiner used improper evidence to deny its application.

Lancome's counsel, Robert L. Sherman of Paul Hastings, alleged the trademark examiner ignored the stylized differences in the company's proposed mark, which includes a superimposed Ô over the “d'AZUR” phrase that distinguishes it from House of D'Azur Inc.'s “D'AZUR” mark. The “D'AZUR” mark is registered for hair spray, hand lotion and deodorant....
