Spectranetics CEO Can't Shake False Statement Conviction

Law360, Los Angeles (January 21, 2014, 4:44 PM EST) -- A Tenth Circuit panel on Tuesday upheld the conviction of medical equipment manufacturer Spectranetics’ chief executive for making false statements to the U.S. Food and Drug Administration, ruling there was enough evidence to show that at least some of his statements were false.

Circuit Judge Terrence L. O’Brien, writing for a unanimous panel, found enough evidence to reasonably support the FDA’s charge that Spectranetics CEO George John Schulte misled an FDA investigation into the company's alleged testing of foreign-made products without FDA approval.
