FTC Pushes Justices To Reject NC State Action Case

Law360, New York (January 23, 2014, 4:37 PM EST) -- The Federal Trade Commission on Wednesday urged the U.S. Supreme Court  to leave in place a ruling that North Carolina's dental board doesn't qualify for so-called state action immunity from federal antitrust scrutiny, saying that the Fourth Circuit correctly interpreted the doctrine.

The North Carolina State Board of Dental Examiners asked the justices in October to review the case, which stemmed from the FTC's crackdown on the board's efforts to block nondentists from offering teeth-whitening services.
