USPTO Sets AIA Review Rules In Nixing Progressive's IP Suit

Law360, New York (January 27, 2014, 7:38 PM EST) -- A U.S. Patent and Trademark Office board on Thursday invalidated a Progressive Casualty Insurance Co. patent for a vehicle monitoring system that helps set insurance costs, rejecting Progressive's argument that the America Invents Act only permits reviews of individual claims, not entire patents.

The Patent Trial and Appeal Board said Progressive, which contended the three-judge panel overstepped its authority by reviewing its whole patent, had misread the AIA, which rendered patents vulnerable to examination based on a single claim.
