Court Tells FERC To Rethink Pipeline Ruling

Law360, New York (March 18, 2008, 12:00 AM EDT) -- A federal appeals court has granted the Williston Basin Interstate Pipeline Co.'s challenge to a federal regulatory order that took away the natural gas company's rights to sell excess capacity on its pipeline, instead allowing one of its shippers to reap the revenues.

In a ruling issued Tuesday, the U.S. Court of Appeals for the District of Columbia Circuit found that the Federal Energy Regulatory Commission's order modifying the company's agreement with shipper Northern States Power Co. was “arbitrary and capricious.”
