Enviro Group Wants 2008 Surface Mining Rule Nixed

Law360, Washington (January 31, 2014, 5:56 PM EST) -- An environmental group urged a Washington federal judge on Friday to throw out a 2008 surface mining rule that the U.S. government now concedes was issued improperly, while a coal interest association argued that the rule should go through a notice and comment period before it's withdrawn.

U.S. District Judge Barbara J. Rothstein heard oral arguments in the National Parks Conservation Association challenging an Office of Surface Mining Reclamation and Enforcement rule that the group claims relaxes restrictions on mining near streams.
