EPA Releases Final Guidance For Fracking With Diesel

Law360, New York (February 11, 2014, 4:57 PM EST) -- The U.S. Environmental Protection Agency on Tuesday released technical recommendations for oil and gas hydraulic fracturing activities that use diesel fuels, attempting to address the uncertainty currently surrounding federal regulation of underground injection control wells.

The guidance document clarifies how companies can comply with permit requirements for fracking with diesel, which is the only type of fracking not exempted from injection control program requirements under the Energy Policy Act of 2005.
