Appeals Court Clears Swift Beef, Others In RICO Suit

Law360 (March 25, 2008, 12:00 AM EDT) -- An appellate court has cast aside a novel attempt by a county in Idaho to use the Racketeer Influenced and Corrupt Organizations Act to recoup money from businesses that the county claimed were employing illegal immigrants.

In the decision Friday, a three-judge panel of the U.S. Appeals Court for the Ninth Circuit said that Canyon County cannot show that it suffered any harm or that it paid additional money to provide services to the allegedly illegal workers.
