Med Cable Color Trademarks Can Be Restricted, TTAB Says

Law360, New York (February 14, 2014, 7:52 PM EST) -- In a dispute between Covidien LP and Masimo Corp. over the color trademarks of medical cables, the Trademark Trial and Appeal Board ruled that a registered mark may be modified to include a more specific color description, according to an opinion declared precedential on Thursday.

The U.S. Patent and Trademark Office's TTAB said that under Section 18 of the Lanham Act, which allows the board to restrict previously registered trademarks, Covidien could request that Masimo’s trademark for red medical cables be revised to contain a narrower color...
