ND Joins High Court Fight Over EPA Haze Authority

Law360, New York (February 14, 2014, 4:40 PM EST) -- North Dakota has asked the U.S. Supreme Court to prevent the U.S. Environmental Protection Agency from tossing the state’s emissions control plan in favor of a federal plan, claiming the Eighth Circuit undermined the Clean Air Act by upholding the agency's decision.

North Dakota Attorney General Wayne Stenehjem said in a Feb. 5 petition for certiorari that the EPA doesn't have the authority to review and replace state implementation plans, or SIPs, for the Clean Air Act's Regional Haze Rule when they meet the program's goals....
