Fed. Circ. Nixes Win For Takeda In Generic Prevacid Case

Law360, New York (February 20, 2014, 4:01 PM EST) -- The Federal Circuit on Thursday reversed a lower court's ruling that Zydus Pharmaceuticals USA Inc.'s planned generic version of the acid reflux drug Prevacid SoluTab infringes a Takeda Pharmaceutical Co. Ltd. patent, finding that the judge relied on an incorrect claim construction.

The appeals court negated a June ruling by U.S. District Judge Joel Pisano, who had enjoined Zydus from selling its proposed generic version until Takeda's patent expires in 2019. The judge found that Zydus infringed under a claim construction that the Federal Circuit said...
