High Court Told Tighter Rules Needed On Ambiguous Patents

Law360, New York (March 3, 2014, 7:19 PM EST) -- Nautilus Inc. asked the U.S. Supreme Court last week to reject the Federal Circuit's standard for determining when a patent is invalid as indefinite, arguing that the appeals court allows too much ambiguity in patent claims and "inflicts tremendous harm on the patent system."

Nautilus filed its merits brief on Feb. 24 in a case the high court agreed to hear in January over the Federal Circuit's rule that a patent is only indefinite if it is "insolubly ambiguous."
