Monsanto Loses Key Biotech Lawsuit In Europe

Law360 (December 3, 2003, 12:00 AM EST) -- Monsanto Co. has lost one patent battle over a key technology used in genetically modifying plants, but says litigation in the U.S. will clarify its intellectual property rights in a long-running dispute with German researchers, the St. Louis Post-Dispatch reported.

Last week, the European Patent Office issued a patent for

agrobacterium-transformation technology to the Max Planck Society, a German research organization. The society gave an exclusive license to Monsanto’s German competitor Bayer CropScience.
