Court Throws Out Derivative Suit Against Guidant

Law360, New York (March 28, 2008, 12:00 AM EDT) -- One month after Guidant Corp. won the dismissal of a securities class action against it, a district court has tossed a derivative suit against the medical device maker, closing the book on another chapter in the litigation stemming from Guidant's merger with Boston Scientific.

In a decision handed down on Thursday, Judge Sarah Evans Barker of the U.S. District Court for the Southern District of Indiana granted Guidant's motion to dismiss the second amended complaint filed by shareholders in the derivative suit against the company....
