Amgen Threatens To Sue If Roche Launches Mircera

Law360 (March 28, 2008, 12:00 AM EDT) -- Amgen Inc. fired off a motion Wednesday against Roche Holding AG in an attempt to prevent Roche from selling Mircera while the federal court is deciding whether or not to issue a permanent injunction in the ongoing anemia drug patent dispute.

Since Mircera's presence in the market would cause Amgen irreparable harm, the company seeks damages from future infringement on its patents should the drug's sale be permitted, the motion said.
