Takeaways From Fed. Circ. Lighting Ballast Ruling

Law360, New York (February 28, 2014, 5:31 PM EST) -- On Feb. 21, 2014, the United States Court of Appeals for the Federal Circuit issued its long-awaited decision in Lighting Ballast Control v. Philips Elecs. N. Am. Corp. et al., holding that the de novo standard of review for district court claim construction determinations shall remain unchanged. The en banc decision, issued as a 6-4 majority opinion, reaffirmed the Federal Circuit’s existing standard set forth in Cybor Corp. v. FAS Techs. Inc., 138 F.3d 1448 (Fed. Cir. 1998) (en banc).
