Justices To Hear NC Dental Board Antitrust Immunity Case

Law360, New York (March 3, 2014, 2:20 PM EST) -- The U.S. Supreme Court agreed Monday to review a Fourth Circuit ruling backing the Federal Trade Commission in its antitrust case against North Carolina's dental board, teeing up the justices' second look at so-called state action immunity in two years.

The court granted a petition for a writ of certiorari from the North Carolina State Board of Dental Examiners, which claims its efforts to block nondentists from offering teeth-whitening services should be immune from the FTC's scrutiny under the state action doctrine.
