High Court Won't Put DuPont On $18M Hook Over Enzyme IP

Law360, Los Angeles (March 3, 2014, 5:52 PM EST) -- The U.S. Supreme Court on Monday refused Novozymes A/S' request for certiorari protesting a lower-court decision that invalidated a patent covering an enzyme used to make ethanol in Novozymes' $18 million infringement fight against a DuPont Co. unit.

The high court said it wouldn't hear Novozymes' appeal after a divided Federal Circuit panel affirmed a lower court's determination that the written description for its U.S. Patent Number 7,713,723 didn't meet the requirements set out under U.S. patent law.
