Environmentalists Claim Duke's N.C. Air Permit Illegal

Law360, New York (March 28, 2008, 12:00 AM EDT) -- Opponents of Duke Energy Corp.'s $2.4 billion project to build a coal-fired power generator at its Cliffside, N.C., power complex are seeking to overturn an air quality permit that the state issued for the facility.

The Southern Environmental Law Center said it filed a contested case petition Thursday against the North Carolina Division of Air Quality, which issued the permit that allowed Duke Energy to begin construction Jan. 30 on a new 800-megawatt plant in western North Carolina.
