Motorola Asks Fed. Circ. To Ground Apple 'Satellite Litigation'

Law360, Washington (April 8, 2014, 8:15 PM EDT) -- Apple Inc. is using a contract and antitrust suit over Motorola Mobility LLC’s smartphone technology licensing practices as “satellite litigation” that is more properly litigated as part of the rivals’ patent infringement dispute, a Motorola attorney told the Federal Circuit on Tuesday, asking the court to affirm dismissal of the suit.

Kathleen Sullivan of Quinn Emanuel Urquhart & Sullivan LLP told a three-judge panel that Apple lacks jurisdiction to appeal the dismissal of the case disputing the high royalties for Motorola’s standard-essential patents.
