Del. High Court Revives RBC Suit Over Interest Payments

Law360, New York (March 5, 2014, 4:49 PM EST) -- Delaware's Supreme Court on Wednesday revived investment bank RBC Capital Markets LLC's suit alleging that U.S. Education Loan Trust IV LLC has failed to pay interest on about $450 million in securities it holds.

The three-judge panel ruled that RBC had presented an adequate case to allow it to satisfy the state's “reasonable conceivability” standard and pursue breach of contract claims against the trust, overturning a 2012 Delaware Superior Court ruling that found the claim lacked standing and had already been subject to a final judgment....
