W.R. Grace Judge Declines To Shield Montana

Law360, New York (April 1, 2008, 12:00 AM EDT) -- A federal bankruptcy judge has reportedly refused to let Montana off the hook from those seeking to hold the state responsible for the asbestos injuries inflicted as a result of its alleged negligence in monitoring the mining activities of W.R. Grace & Co.

U.S. Bankruptcy Judge Judith Fitzgerald on Monday denied Montana's request for an injunction, leaving the state vulnerable to lawsuits from individuals seeking recourse in connection with the contaminated Libby, Mont., operation site, according to the Wall Street Journal.
