Fed. Circ. Axes $3.5M Patent Verdict Against Safeway Unit

Law360, New York (March 12, 2014, 4:59 PM EDT) -- The Federal Circuit nixed a $3.5 million infringement verdict against a Safeway Inc. subsidiary on Wednesday, ruling that a lower court had misconstrued a claim in patent covering gift-card processing technology held by Interactive Communications International Inc.

Siding with Safeway's gift card unit Blackhawk Network Inc., the three-judge appeals panel ruled that U.S. Magistrate Judge Stephen Crocker had misconstrued a patent claim regarding how InComm’s computer program determines if a retailer’s point-of-sale device is authorized to make a gift card transaction.
