Food Distributor Can't Dodge EEOC Sex Bias Suit

Law360, New York (March 12, 2014, 9:16 PM EDT) -- A food distributor sued for refusing to give women jobs involving machinery and processing equipment lost its bid to dismiss the case Wednesday, with a Maryland federal judge ruling the U.S. Equal Employment Opportunity Commission had viable discrimination claims.

In its September motion to dismiss, Performance Food Group Inc. argued that the EEOC generally failed to state a plausible claim, and that any plausible claims that point to discrimination and disparate treatment prior to Oct. 12, 2007, should be dismissed because they are time-barred. PFG added...
