Respironics Wins Judgment in Antitrust Case

Law360, New York (April 2, 2008, 12:00 AM EDT) -- A federal judge tossed the last of Invacare Corp.'s antitrust claims against Respironics Inc. on Monday, finding the medical-device-maker's donation of its products and other goods and services to sleep labs and suppliers did not constitute exclusive agreements with the recipients.

Judge Solomon Oliver Jr. of the U.S. District Court for the Northern District of Ohio, who had granted Respironics a partial summary judgment in October 2006, dismissed the remaining federal and state restraint of trade claims Monday.
