8th Circ. Nixes Breastfeeding Bias Suit Against Nationwide

Law360, New York (March 18, 2014, 3:47 PM EDT) -- The Eighth Circuit has refused to revive a discrimination suit lodged by a former Nationwide Mutual Insurance Co. employee who claims she was pressured to resign on her first day back from maternity leave after being denied immediate access to a lactation room.

Former loss-mitigation specialist Angela Ames cannot bring sex- and pregnancy-based discrimination claims against Nationwide, the appeals court said in a decision handed down Thursday, finding that she could not show that her resignation amounted to a constructive discharge by the insurer.
