DC Circ. Won't Reconsider Nixing $750M In Nuke Waste Fees

Law360, New York (March 18, 2014, 4:21 PM EDT) -- The D.C. Circuit on Tuesday snubbed the U.S. Department of Energy’s request for the full court to reconsider a panel ruling ordering the department to stop assessing nuclear power plant operators $750 million in annual waste fees.

The DOE's petition, which argued that the panel’s November ruling was illegal and trampled on the judgments of both Congress and the secretary of energy, failed to win votes of support from a majority of the judges eligible to participate.
