Greenberg Traurig Wants Sanctions Upheld For Deleting Data

Law360, Los Angeles (March 20, 2014, 7:09 PM EDT) -- Greenberg Traurig LLP urged a California appeals court Thursday to uphold sanctions against appellants accusing the firm and a former partner of fraud in seeking to dissolve the appellants’ company, saying attorney-client privilege had been waived over computer files Greenberg sought during discovery, making their deletion sanctionable.

Greenberg Traurig argued that the $164,000 in terminating and monetary sanctions was justified after the appellants, shareholders at CMW Technology LLC, deleted thousands of files across multiple computers that a trial court had ordered preserved.
