New EU Rules Tighten Antitrust Checks On Patent Deals

Law360, New York (March 21, 2014, 6:45 PM EDT) -- The European Commission finalized new rules Friday excluding certain kinds of patent licensing restrictions from a block antitrust exemption meant to promote innovation and research through technology licensing deals.

Though the new rules continue to promote most patent licensing agreements as pro-competitive and exempt from antitrust scrutiny, the EC decided that some clauses that could threaten competition would be excluded from the automatic exemption.
