Pa. Appeals Court Dumps $1.4M Trade Secrets Award

Law360, Philadelphia (March 21, 2014, 5:34 PM EDT) -- The Pennsylvania Superior Court on Friday vacated a $1.4 million damages verdict in a trade secrets case between two companies who manufacture and sell devices for low temperature scientific research, saying the monetary damages awarded at the bench trial were ambiguous.

The three-judge panel ruled that Advanced Research System Inc.’s technologies did qualify as protected trade secrets, but it favored ColdEdge Technologies Inc. and its four founders — who formerly worked at ARS — on the question of damages.
