NC Asks Court To Nix Coal Ash Settlement With Duke Energy

Law360, New York (March 21, 2014, 7:08 PM EDT) -- North Carolina officials told a state judge on Friday that they want out of a proposed consent decree with Duke Energy addressing wastewater discharges and groundwater contamination at two coal ash impoundments, arguing that a recent court ruling undercuts the deal's legal foundation.

The North Carolina Department of Environment and Natural Resources settlement was negotiated based on the state's Environmental Management Commission interpretation that Duke could craft a corrective action plan before addressing the source of the pollution, but that ruling was reversed earlier this month....
