Insurer Has No Duty In RICO Suit Over Steel Cos.' Dumping

Law360, Los Angeles (March 25, 2014, 8:40 PM EDT) -- An Indiana federal judge on Tuesday ruled that Savers Property & Casualty Insurance Co. was not obligated to defend or indemnify its insured in a Racketeer Influenced and Corrupt Organizations Act suit over the alleged cover-up of illegal hazardous waste dumping by several steel companies.

In 2012 the insurer sued Industrial Safety & Environmental Services Inc. and its president, Tristan O. Gour, seeking a declaration that the allegations against Gour in the underlying RICO suit didn't qualify for coverage under the commercial lines policy Savers issued...
