Belgian Court Invalidates Louboutin Red Sole Trademark

Law360, Los Angeles (March 31, 2014, 8:30 PM EDT) -- A Belgian court has invalidated Christian Louboutin SA's registered trademark on red-soled shoes in the three-country region known as the Benelux, ruling that the red sole can't be trademarked under European law because it gives substantial value to Louboutin's shoes.

Judge Natalie Swalens of the Brussels District Court rendered the decision in Louboutin's trademark infringement lawsuit against Netherlands-based shoe company Van Dalen Footwear BV, granting Van Dalen's counterclaim for invalidity while denying Louboutin's infringement claim.
