Judge OKs Massey's $20M Settlement With EPA

Law360, New York (April 10, 2008, 12:00 AM EDT) -- A federal judge has approved the largest civil penalty for wastewater discharge violations in the U.S. Environmental Protection Agency's history, settling the case against Massey Energy Co. with a $20 million fine.

“The court finds that the proposed consent decree is fair, adequate, and reasonable. The court further finds the accord is neither illegal nor the product of collusion and that it serves the public interest,” Judge John T. Copenhaver Jr. of the U.S. District Court for the Southern District of West Virginia said Wednesday....
