Constellation Sues Over Power Purchase Agreement

Law360, New York (April 15, 2008, 12:00 AM EDT) -- Constellation Energy Commodities Group Inc. has filed suit against retail electric distribution company the Narragansett Electric Co., claiming the Rhode Island company breached its contracts by attempting to pay Constellation less than promised for its electricity.

In its complaint filed Monday in the U.S. District Court for the District of Massachusetts, Constellation sought declaratory relief for NEC’s alleged breach of two Wholesale Standard Offer Service Agreements that NEC’s predecessors entered into in 1998 in order to purchase wholesale electric power from Constellation.
