J&J Unit Gets Punitives Barred In Pa. Risperdal Cases
By Matt Fair (May 7, 2014, 6:42 PM EDT) -- A Johnson & Johnson unit notched a victory on Friday as a Pennsylvania judge ruled that punitive damages were off the table for nearly 500 plaintiffs pursuing claims as part of a thriving mass tort program in Philadelphia over alleged injuries from the antipsychotic drug Risperdal.
Judge Arnold New in the Philadelphia Court of Common Pleas accepted arguments leveled by Janssen Pharmaceuticals Inc. claiming that the company's overwhelming presence in New Jersey warranted the application of the New Jersey Products Liability Act and its ban on the award of punitive damages to the plaintiffs.
