Smallpox Drug Makers Fight Patent War On Two Fronts

Law360, New York (February 16, 2006, 12:00 AM EST) -- With millions of U.S. anti-terror funding in the balance, smallpox vaccine maker Bavarian-Nordic has sued rival drug maker Acambis Inc. for patent infringement in Austria with an eye to shutting down its manufacturing plant there.

Three months after the European Patent Office granted Bavarian-Nordic a patent covering the company’s smallpox vaccine technology, including crucial component MVA-BN, the Big Pharma remains determined to enforce its intellectual property rights in court.
