Cadbury Blue Over Aussie Ruling On Purple

Law360, New York (April 18, 2008, 12:00 AM EDT) -- An Australian court has rejected Cadbury Schweppes Pty Ltd.'s argument that a rival confectionery company's use of the color purple on its chocolates misled consumers into believing the products were Cadbury brand chocolates.

Justice Peter Cadden Heerey of the Federal Court of Australia in Melbourne ruled on April 11 that Darrell Lea Chocolate Shops Pty Ltd did not violate the country's Trade Practices Act of 1974 by using a certain shade of purple in connection with its business.
