Federal Circuit Halts Energizer Battery Patent Claims

Law360, New York (April 21, 2008, 12:00 AM EDT) -- A federal appeals court has affirmed a U.S. International Trade Commission ruling, holding that an Energizer Holdings Inc. battery patent that was asserted against Chinese battery manufacturers on infringement claims was invalid.

In a 2-1 decision, the U.S. Court of Appeals for the Federal Circuit ruled on Monday that Energizer and subsidiary Eveready Battery Co. Inc.'s patent for mercury-free alkaline batteries was invalid because of problems with the patent's claim language.
